The decision of the Tribunal was as follows:-
The claimant resigned in circumstances within Section 9 (1)(C) of the Redundancy Payments Act, 1967, and is, therefore, deemed to have been dismissed by reason of redundancy.
The claimant is entitled to a redundancy payment based on:
Service from: 18 March 2008 to 31 January 2012
Normal weekly remuneration: €720.15
Non-reckonable service: nil
Amount of redundancy payment: €5,256.00
A ceiling of €600.00 applies to any payments from the Social Insurance Fund and this award is subject to the claimant having been in employment which is insurable for all purposes under the Social Welfare Consolidation Act, 2005.
