This appeal came before the Tribunal by way of an employee (the appellant) appealing the decision of a Rights Commissioner (reference: r-122366-ud-12/EH) under the Unfair Dismissals Acts, 1977 to 2007.
There was no appearance or representation for the employer in this case. The Tribunal is satisfied that proper notification was sent to the employer.
The employer was not present at the Rights Commissioner hearing and the appellant employee succeeded in his claim and the Rights Commissioner awarded compensation. The employee is appealing the amount of compensation.
Accordingly having heard the appellant’s evidence as to loss and mitigation of loss the Tribunal, varies the Rights Commissioner’s recommendation (reference: r-122366-ud-12/EH) and awards the appellant the sum of €5,000.00, as compensation under the Unfair Dismissals Acts, 1977 To 2007.
