This case came before the Tribunal by way of an appeal by an employee (appellant) appealing against the recommendations of the Rights Commissioner reference numbers: r-124188-pw-12/MMG and r-124199-te-12/MMG.

The decision of the Tribunal was as follows:-

Determination:

The Tribunal was informed at a previous hearing, Tuesday June 10^th 2014, by the appellant’s solicitor on record that he had difficulty contacting his client and had no instructions from him in respect of his appeals.

The Tribunal are satisfied that the appellant was properly notified of the time, date and location of the hearing. He was not present of the day of the hearing to prosecute his appeals.

Therefore the appeals under the Payment of Wages Act, 1991 and the Terms of Employment (Information) Act, 1994 and 2001 are dismissed.
