Determination
The Tribunal is satisfied that both parties were properly on notice of the hearing. The appellant gave direct evidence that she worked on a full-time basis for the respondent company from June 2001. She continued in full-time employment until 17 July 2010 when she was placed on reduced hours (3 days per week). She gave evidence that continually thereafter she requested full-time hours as there was plenty of work available. She made such a formal request in writing on 13 July 2011 but same was refused and she continued working on reduced hours until the termination of her employment by way of redundancy on 4 January 2012.
Taking these circumstances into consideration the Tribunal finds the appellant is entitled to a lump sum payment under the Redundancy Payments Acts 1967 to 2007 based on the following criteria:
Date of commencement of employment: 13 June 2001
Date of termination of employment: 4 January 2012
Gross weekly pay: €488.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
