The declaration of the Tribunal was as follows:-

At the outset the claim under the Organisation of Working Time Act, 1997 was withdrawn.

Determination:

The Tribunal has carefully considered the evidence and submissions adduced by both parties in this matter. It appears, from evidence adduced the appellant is still employed by the respondent, albeit, on a 3-day week. The respondent confirmed this also.

Accordingly, the appeal under the Redundancy Payments Acts, 1967 to 2007 fails.
