1. Complaint that a Rights Commissioner's Decision was not implemented r-132633/132635-wt-13/SR.
BACKGROUND:
2. The Worker referred her case to the Labour Court on the 20th October 2014, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Determination of the Court:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of working Time Act 1997 by Dorothy Marshall, that her former, Kathyrn Tracey and Niall Tracey t/a Tanzone, 32, Templeogue Lodge, Templeogue Dublin 6W failed to implement Decisions of a Rights Commissioner r-132633-wt-13/SR and r-132635-wt-13/SR.
And the said Decision not having been carried out by the employer, and no appeal having been brought against the said Decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €3,000 in accordance with the Decision of the Rights Commissioner.
