1. Complaint that a Rights Commissioner's Decision was not implemented R-132020-WT-13/EOS
BACKGROUND:
2. The Worker referred her case to the Labour Court on the 16th October, 2014 in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Determination of the Court:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act 1997 by Stec Katarzyna, that her former employer Kevin Blake t/a Spar Castleknock, 41, Forest Crescent, Rivervalley, Swords, County Dublin failed to implement decisions of a Rights Commissioner r-132020-wt-13; 132021-wt-13.
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €1,500, being compensation of €150 in respect of a contravention of s.11 of the Act; €350 in respect of a contravention of s.12 of the Act and €1,000 in respect of a contravention of s.20 of the Act, in accordance with the decision of the Rights Commissioner.
