Representation:
Claimant: Mr. Derek Dunne BL instructed by Sean Ormond & Co., Solicitors,
Suite 9, The Atrium, Canada Street, Waterford
Respondent: Company representative
The determination of the Tribunal was as follows:-
The claims under the Unfair Dismissals Acts, 1977 to 2007, Minimum Notice and Terms of Employment Acts, 1973 to 2005 and the Organisation of Working Time Act, 1997, were withdrawn during the hearing. It was conceded that a redundancy situation existed in regard to the claimant’s employment as the role of warehouse supervisor that he held was being abolished.
Accordingly, the Tribunal finds that the claimant is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following information:
Date of Birth:
Date of Commencement: 19th January 2000
Date of Termination: 14th June 2011
Gross Weekly Pay: €742.00
Statutory Redundancy Entitlement: €14,292
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period. It should be noted that a statutory weekly ceiling of €600.00 applies to payments from the Social Insurance Fund.
