The decision of the Tribunal was as follows:-
This case came to the Tribunal as an employee appeal under the Payment of Wages Act, 1991, against Rights Commissioner Decision r-128855-pw-12.
After the appellant failed to present himself at the Tribunal hearing scheduled for him or previously to successfully apply to a sitting division of the Tribunal for a postponement, the respondent’s representative, who had duly presented himself and his client at the Tribunal hearing, applied that the appeal be struck out for want of prosecution.
Determination:
Given that the appellant failed to present himself at the Tribunal hearing scheduled for him or previously to successfully apply to a sitting division of the Tribunal for a postponement, the Tribunal has no option but to accede to the application of the respondent’s representative and order that the employee appeal under the Payment of Wages Act, 1991, against Rights Commissioner Decision r-128855-pw-12 be struck out for want of prosecution.
