The decision of the Tribunal was as follows:-
The appellant claimed that her employment, which commenced on 1 February 2010, ended by reason of redundancy on 23 January 2013. Her gross weekly pay was €200.00 at €10.00 per hour.
A claim was also made under the Organisation of Working Time Act, 1997, in respect of pay outstanding for some ten days of public holidays at the time of termination of employment with the respondent.
No respondent evidence was offered to dispute the appellant’s claims.
Determination:
Under the Redundancy Payments Acts, 1967 to 2007, the Tribunal finds that the appellant is entitled to a redundancy lump sum based on the following details:
Date of birth:
Date of commencement: 01 February 2010
Date of termination: 23 January 2013
Gross weekly pay: €200.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
In addition, the Tribunal awards the appellant the sum of €400.00 (this amount being equivalent to two weeks’ gross pay) under the Organisation of Working Time Act, 1997, in respect of holidays outstanding at the time of termination of her employment with the respondent.
