Appellant(s) : In person
Respondent(s) : In person
The decision of the Tribunal was as follows:
The claimant told the Tribunal that he worked for the respondent from 1st March, 2002 until 8th November, 2012. He did not receive his redundancy entitlement or minimum notice.
The respondent explained that a redundancy situation occurred in relation to the appellant’s position. The responded conceded the appeal under the Redundancy Payments Acts, 1967 to 2007 and indicated that he would be unable to pay the claimant due to an imminent bankruptcy situation.
On the uncontested evidence of the appellant, the Tribunal finds that the appellant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of birth:
Date of commencement: 1st March 2002
Date of termination: 8th November, 2012
Gross weekly pay: €496
The Tribunal also awards the appellant his statutory entitlement of €2,976, being the sum due for six weeks’ notice, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
