The appellant did not deny that his employment with the respondent ended in December 2008 and that more than two years elapsed before a redundancy appeal was lodged with the Tribunal.
Determination:
Redundancy appeals should be lodged with the Tribunal within twelve months of termination of employment but the Tribunal can extend this by a further twelve months with reasonable cause. However, the Tribunal has no power to extend beyond two years.
The appeal under the Redundancy Payments Acts, 1967 to 2007, fails.
