This case came before the Tribunal where the appellant was appealing the Rights Commissioner recommendations under the Terms of Employment (Information) Act, 1994 and 2001, reference: r- 126581-te-12/SR and the Organisation of Working Time Act, 1991 reference: r- 126584-wt-12/SR.

The decision of the Tribunal was as follows:-

Determination:

The Tribunal are satisfied that the appellant was properly notified of the date, date and location of the hearing in Monaghan Courthouse on the 31^st October 2014. The representative for the respondent requested the appeals be struck out due to the non attendance of the appellant to give sworn evidence in these matters.

Accordingly, the appeals under the Terms of Employment (Information) Act, 1994 and 2001 and the Organisation of Working Time act, 1991 are dismissed for failure to prosecute.
