EMPLOYMENT APPEALS TRIBUNAL
APPEAL OF: CASE NO.
Siobhan Coll
TE26/2014
against the recommendation of the Rights Commissioner in the case of:
Mangan Tours
Joseph Mangan
under
TERMS OF EMPLOYMENT (INFORMATION) ACT, 1994 AND 2001
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms. E. Daly B.L.
Members: Mr. D. Morrison
Ms. R. Kerrigan
heard this appeal at Letterkenny on 26th June 2014
Representation:
Appellant: Hartnett Hayes, Solicitors, Gweedore Road, Dungloe, Co Donegal
Respondent: Purdy Fitzgerald, Solicitors, Kiltartan House, Forster St., Galway
This case came to the Tribunal as an employee appeal against Rights Commissioner Recommendation r-131141-te-13/SR by which the employee was awarded no compensation under the Terms of Employment (Information) Acts, 1994 and 2001, because the Rights Commissioner found that, in the circumstances, no amount was warranted.
Determination:
Having considered the position of both sides, the Tribunal determines that it upholds Rights Commissioner Recommendation r-130220-te-13/JC. It is common case that the respondent did provide a written statement to the appellant when she commenced employment in 2007. Changes were made to her terms and conditions during her tenure. These were communicated verbally, no grievance was raised and some were to her advantage.
Sealed with the Seal of the
Employment Appeals Tribunal
