At the outset of this hearing the respondent conceded the claim under the Unfair Dismissals Acts. As a consequence the respondent presented no evidence. The company also made an open offer to the claimant to settle the case. That offer was declined and the hearing proceeded.
The determination of the Tribunal was as follows:
Claimant’s Case
Prior to commencing employment with the respondent in 2010 the claimant had acquired experience in dealing with financial accounts. Her main area of work with the respondent was in accounts and she felt competent to undertake those duties. She described being devastated when the respondent dismissed her in July 2012. She felt that this sanction was undeserved and unwarranted. Then witness acknowledged receiving one month’s notice pay and confirmed to the Tribunal that she commenced new employment less than four weeks following her last day of work with the respondent.
Determination
Having considered the uncontested evidence of the claimant the Tribunal is satisfied that the claimant was unfairly dismissed by the respondent. In noting that the claimant did not suffer a financial loss from that termination it awards her €1791.00 as compensation under the Unfair Dismissals Acts, 1977 to 2007 that sum being the equivalent four weeks’ pay.
