The determination of the Tribunal was as follows:-
The representatives and witnesses on behalf of the respondent attended to contest the unfair dismissal claim. As the claimant or a representative on his behalf did not attend before the Tribunal the respondent applied to have the case struck out.
Determination:
The claim under the Unfair Dismissals Acts, 1977 to 2007, is dismissed for want of prosecution.
Note: An application had not been made by the claimant or a representative on his behalf, to a sitting division of the Tribunal, by the close of business on 9 October 2014, to postpone the hearing of this claim. On 8 October 2014 the claimant’s solicitors wrote to the Tribunal informing it that the claimant had instructed them not to act on his behalf at the hearing on 10 October 2014.At 22.23 on 9 October 2014, long after the close of business, the claimant sent an e-mail to the Tribunal secretariat at the Dublin headquarters to say that he was unable to travel to Ireland to attend his hearing on Friday 10 October 2014. This late communication was only received in Cork after the hearing herein had concluded and the division had dispersed.
