The determination of the Tribunal was as follows:-
Background:
This case came before the Tribunal where the appellant was seeking implementation of the Rights Commissioner recommendations under the Unfair Dismissals Acts, 1977 to 2007, reference r-126398-ud-12/JT and the Terms of Employment (Information) Act, 1994 and 2001 reference r-126392-te-12/JT.
Determination:
The Tribunal was satisfied that the respondent was duly notified of this hearing. Neither the respondent nor a representative appeared on their behalf.
The Tribunal being satisfied that the recommendations under the Unfair Dismissals Acts, 1997 to 2007 and the Terms of Employment (Information) Act, 1994 and 2001, has not been implemented by the respondent, the time for bringing any appeal against the recommendations has expired and no such appeals having been brought, makes an order to the like effect as the decision. The Tribunal orders that the Rights Commissioner’s recommendations be implemented in respect of the award of €15,000.00 under the Unfair Dismissals Acts, 1977 to 2007 and in respect of the award of €2,000.00 under the Terms of Employment (Information) Act, 1994 and 2001.
