1. Hearing arising from LCR 20320.
BACKGROUND:
2. In LCR 20320, the Court recommended that the parties should enter negotiations on the design and introduction of an incentive scheme and that if agreement was not reached the matter could be referred back to the Court for a definitive recommendation. On 30th September, 2013, the Union requested the Court to issue a definitive recommendation. A Labour Court hearing took place on the 7th February, 2014.
UNION'S ARGUMENTS:
3 1 The Union is seeking an incentive scheme which will enable the Workers to achieve enhanced earnings.
2 This will be done on a cost neutral basis by linking payments to increased output and productivity.
3 The Company's proposal is not achievable.
COMPANY'S ARGUMENTS:
4 1 The Company proposals originated in a scheme operated by the site 'customer' in their warehouse.
2 The Company believes that it has fully conformed with the requirements of LCR 20320.
3. The Company proposal is reasonable and should proceed.
RECOMMENDATION:
The Court is satisfied that the terms of the bonus scheme proposed by the Company are in line with those of the scheme operated by its main customer. Accordingly, it meets the terms of Recommendation LCR 20320. On that basis the Court recommends that the scheme as offered by the Company should be accepted.
A comprehensive review of the scheme should be undertaken after it has been in operation for 6 months. Furthermore, should the terms of the bonus scheme operated by the Company’s main customer be changed a review should take place with a view to maintaining alignment with that scheme.
