Respondent’s case:
There was no appearance by or on behalf of the respondent and the Tribunal is satisfied that they were properly notified of the hearing.
Claimant’s case:
The claimant commenced employment with the respondent on 3rd May 2011 and on 23rd September 2011 he received a phone call from the respondent to say that there was no more work for him. That was the last day of the claimant’s employment with the respondent and he never received payment in lieu of notice.
At the time of termination of employment the claimant was earning €500.00 per week.
Determination
Having considered the uncontested evidence of the claimant the Tribunal is satisfied that he did not receive any notice of termination of employment from the respondent, nor did he receive payment in lieu of such notice.
Therefore the Tribunal awards the claimant €500.00 being one week’s wages under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
