This case came before the Tribunal by way of an employer appeal of the Rights Commissioner Recommendation and Decision ref: r-119547-pw-12/JW and r-119545-te-12/JW.
Having heard sworn evidence from both parties the Tribunal varies the Rights Commissioner Decision ref: r-119545-te-12/JW under the awards theTerms of Employment (Information) Act, 1994 and 2001 and awards the respondent (employee) €2,184.00 in compensation.
The respondent employee maintains that he should have been paid in accordance with the Construction Industry Registered Employment Agreement. The Tribunal is not satisfied that this agreement applies to the respondent employee and therefore upsets the decision of the Rights Commissioner r-119547-pw-12/JW.
