This case came before the Tribunal by way of an appeal by an employee against a decision of the Rights Commissioner under the Payment of Wages Act, 1991 ref: r-066346-pw-08.
The decision of the Tribunal was as follows:-
Background:
The issue before the Tribunal is a sum of €54.00, this being 8 hours wages.
The respondent claims the appellant was overpaid for hours paid while absent on sick leave as he had already been paid over and above the allowed entitlement in their guidelines / appellant’s contract of employment of 56 hours.
The appellant claims he is entitled to be paid these monies.
Determination:
The Tribunal has carefully considered the matter and find the respondent acted in accordance with the provisions of the appellant’s contract of employment in respect of sick pay and upholds the Rights Commissioners decision under the Payment of Wages Act, 1991.
