On the evidence put forward to the Tribunal it was considered that a genuine redundancy situation did not exist within the respondent company. The appellant gave evidence of being dismissed during a period of sick leave. She was replaced with no diminution of work.
The appeal under the Redundancy Payments Acts 1967 to 2007, fails.
