The decision of the Tribunal was as follows:
While all parties accepted that the appellant’s employment with the respondent was terminated by way of redundancy they parted company on final redundancy amount to be payable. Those differences were resolved and as a result a common revised calculation agreed.
The appeal under the Redundancy Payments Acts, 1967 to 2007 is allowed and the appellant is awarded a statutory lump sum payment under those Acts, and based on the following:
Date of Birth: n/a
Date of Commencement : 17 January 2001
Date of Termination: 16 May 2012
Gross Weekly Wage: €367.77
According to the redundancy calculator from the Dept. of Social Protection and based on the above the total statutory amount is €8708.79. Since the appellant had previously received €5247.49 in respect of this redundancy that amount must be offset from the total statutory payment.
This award is made subject to the appellant having been in insurable employment under the appropriate Social Welfare Acts during the relevant period.
