The decision of the Tribunal was as follows:
Having heard the brief uncontested submission from the appellant the Tribunal is satisfied that the appellant’s employment with the respondent was terminated by way of redundancy. The appeal under the Redundancy Payments Acts, 1967 to 2007 is therefore allowed and the appellant is awarded a statutory lump sum under those Acts, and based on the following:
Date of Birth: 03 February 1982
Date of Commencement; 01 December 2009
Date of Termination: 19 June 2012
Gross Weekly Wage: €287.50
This award is made subject to the appellant being in insurable employment during the relevant time.
The appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 is also allowed and the appellant is awarded €575.00 as compensation for two weeks’ notice.
The appeal under the Organisation of Working Time Act, 1997 succeeds and the appellant is awarded €2587.50 as compensation for outstanding holiday entitlements.
