APPEAL OF: CASE NO.
EMPLOYEE RP729/2013, MN546/2013
WT185/2013
against
EMPLOYER
Under
REDUNDANCY PAYMENTS ACTS, 1967 TO 2007
MINIMUM NOTICE AND TERMS OF EMPLOYMENT ACTS, 1973 TO 2005
ORGANISATION OF WORKING TIME ACT, 1997
I certify that the Tribunal
(Division of Tribunal)
Chairman: Mr P. O'Leary B L
Members: Mr C. Lucey
Mr F. Keoghan
heard this appeal at Dublin on 28th January 2014
Representation:
Appellant : In person
Respondent : Mr. Paul O'Brien, O'Brien & Co., Fitzwilliam Hall, Fitzwilliam Place, Dublin 2
Having heard and considered the brief submissions of the appellant the Tribunal finds it has no jurisdiction to hear the appeal under the Redundancy Payments Acts, 1967 to 2007 as the appellant did not have sufficient service with the respondent to prosecute an appeal under those Acts.
The appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 is allowed and the appellant is awarded €230.00 as compensation for one week’s notice.
The appeal under the Organisation of Working Time Act, 1997 also succeeds and the appellant is awarded €1334.00 as compensation under that Act for outstanding leave entitlements.
Sealed with the Seal of the
Employment Appeals Tribunal
