The decision of the Tribunal was as follows:-
Determination
The Tribunal has carefully considered the evidence adduced. The appellant is seeking redundancy arising out of the termination of his employment in and around the spring of 2012.
It is common case that that the appellant was put on short time on the 19th of March 2012. The appellant worked on and off in the aftermath of the notice of short time. The work was erratic with several weeks of no work at all. The appellant was paid his last pay cheque on the 27th of April 2012.
The appellant notified his employer of his intention to claim a redundancy lump sum on the 13th of June 2012.
The Tribunal find the appellant satisfied the criteria set out in Section 11 of the Redundancy Payments Acts and awards a lump sum payment under the Redundancy Payments Acts 1967 to 2007 based on the following information:
Date of Birth: 07 July 1976
Date of Commencement: 14 July 2008
Date of Termination: 14 April 2012
Weekly Gross Pay: €476.00
The award made under the Redundancy Payments Acts, 1967 to 2007 is made subject to the appellant having been in insurable employment under the Social Welfare Consolidation Act, 2005 during the relevant period.
