The decision of the Tribunal was as follows:-
Determination
The respondent’s evidence was that they had operated as building contractors for over forty years. The downturn in the economy led to the closing down of the business and in turn led to the redundancy of all employees including the appellant.
The respondent having conceded a redundancy situation existed in this case award a lump some payment under the Redundancy Payments Acts 1967 to 2007 based on the following information:
Date of Birth: 9 August 1973
Date of Commencement: 6 July 1996
Date of Termination: 15 December 2009
Weekly Gross Pay: €600
This award is made under the Redundancy Payments Acts, 1967 to 2007 and is made subject to the appellant having been in insurable employment under the Social Welfare Consolidation Act, 2005 during the relevant period. It should be noted that payments from the social insurance fund are limited to a maximum of €600 per week.
