EMPLOYMENT APPEALS TRIBUNAL
CLAIM(S) OF: CASE NO.
UD1489/2012
EMPLOYEE - Claimant
against
EMPLOYEE - Respondent
under
UNFAIR DISMISSALS ACTS, 1977 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms. N. O’Carroll Kelly BL
Members: Mr. J. Horan
Mr. S. O’Donnell
heard this claim in Dublin on 2 January 2014
Representation:
Claimant(s): Mr. Tom Halligan, Gaffney Halligan & Co., Solicitors, Artane Roundabout,
Malahide Road, Dublin 5
Respondent(s): Not Present or Represented
The determination of the Tribunal was as follows:-
Background:
Neither the respondent nor a representative on their behalf attended the hearing on the 2nd January 2014.
The claimant did not attend. However, the claimant’s solicitor attended on his behalf. He informed the Tribunal that he had been in contact with his client that morning who informed him he would not be attending the hearing as he assumed the matter had been finalised when the respondent was put into UK Administration.
Determination:
The Tribunal determines that as the claimant did not attend the hearing, his claim under the Unfair Dismissals Acts, 1977 to 2007 fails for want of prosecution.
