The determination of the Tribunal was as follows:-
When the claimant failed to appear at the scheduled time to prosecute his claim the Tribunal allowed some extra time for the claimant to make a late appearance. However, the Tribunal was conscious that the respondent had engaged representation and had brought witnesses for the hearing.
Determination:
Given the absence of the claimant to whom the Tribunal had sent a hearing notice at the address for him that was last known to the Tribunal, the Tribunal has no option but to dismiss the claim under the Unfair Dismissals Acts, 1977 to 2007, for want of prosecution.
