The determination of the Tribunal was as follows:
Determination:
During the course of the hearing the Tribunal became aware that the claimant, having less than twelve months service such that she was unable to pursue a claim under the Unfair Dismissals Acts, had lodged a complaint with the Rights Commissioner service. At the hearing of that complaint the Rights Commissioner recommended that the claimant return to work with no break in service. That being the case the Tribunal is satisfied that a claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 does not arise.
