Determination
Neither the appellant nor the respondent appeared for this hearing; the Tribunal are satisfied that both were on notice of this hearing. At the commencement of the hearing the appellant’s representative made an application to have this case postponed which was refused by the Tribunal.
This case came before the Tribunal by way of an employee appeal of the Rights Commissioners Decision ref: r-116257-pw-11 JOC. As the claimant did not attend the Rights Commissioner hearing she is appealing the decision that the claim ‘falls for want of prosecution.’
As the appellant again failed to attend the hearing, the Tribunal dismisses the appeal of the Rights Commissioners Decision ref: r-116257-pw-11 JOC therefore upholding the Rights Commissioner’s Decision.
