The determination of the Tribunal was as follows: -
Determination
At the outset the first instance claims of both appellants under the Unfair Dismissals Acts, 1977 to 2007, the Redundancy Payments Acts, 1967 to 2007 and the Organisation of Working Time Act, 1997 were withdrawn.
The evidence having shown that the recommendations had not been carried out by the respondent, the time for bringing appeals against the recommendations having expired and no such appeals having been brought, the Tribunal makes orders to the like effect as the recommendations. Accordingly the Tribunal awards the first named appellant €1,000-00 and the second named appellant €5,000-00 under theUnfair Dismissals Acts, 1977 to 2007.
Loss having been established the Tribunal further awards the first named appellant €960-00 and the second named appellant €1,600-00, both being four weeks’ pay, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
