CLAIM OF: CASE NO.
Employee UD1456/2012
- claimant
against
Employer
- respondent
under
UNFAIR DISMISSALS ACTS, 1977 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms M. Levey B.L.
Members: Mr. T. O'Grady
Mr. J. Maher
heard this claim at Dublin on 9th December 2013
Representation:
Claimant: Ms Mary Duffy-King, Siptu, Misc Unit,
Liberty Hall, Dublin 1
Respondent: Arthur Cox, Solicitors,
Earlsfort Centre, Earlsfort Terrace, Dublin 2
Mr David Carson, Deloitte & Touche, Deloitte House
29 Earlsfort Terrace, Dublin 2
Determination:
There was no appearance by the respondent. The respondent’s legal representative informed the Tribunal in writing that the respondent company is in receivership and that the Receiver would not be contesting the claim.
Accordingly, the Tribunal heard the uncontested evidence of the claimant. The claimant gave evidence that the respondent company sought to have her contract changed. If she did not agree she would be dismissed.
The Tribunal determine that the claim under the Unfair Dismissals Acts, 1977 To 2007, succeeds. The Tribunal determines that the most appropriate remedy be compensation and awards the claimant the sum of €7,500.00, as compensation under the terms of the Unfair Dismissals Acts, 1977 To 2007.
