Background:
The claimant withdrew his claims under the Unfair Dismissals Acts, 1977 To 2007 and the Organisation of Working Time Act, 1997. The claimant opted to prosecute his claims under the Redundancy Payments Acts 1967 to 2007 and the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
Determination:
The claim under the Unfair Dismissals Acts, 1977 To 2007, was withdrawn. The Tribunal dismiss the claim under that Act.
The claim under the Organisation of Working Time Act, 1997, was withdrawn. The Tribunal dismiss the claim under that Act.
The Tribunal heard evidence from the claimant regarding his redundancy claim. A letter from the employer dated 15th August 2011 was opened to the Tribunal. The letter stating that due to a reduction in business the respondent had to terminate the claimant’s employment.
The claim under the Redundancy Payments Acts 1967 to 2007 succeeds and the Tribunal awards the claimant a lump sum redundancy payment based on the following information:
