This case came before the Tribunal by way of the appellant (the employer) appealing against the Recommendation of the Rights Commissioner reference ref.r-124566-ud-12/RG
The determination of the Tribunal was as follows:-
Appellant’s Case
The appellant’s legal representative told the Tribunal that he was appearing as a courtesy to the Tribunal. He had no instructions from the appellant and as the appellant was not present he could not call evidence and therefore he could not proceed with the appeal.
Respondent’s Case
There was a typographical error in the Rights Commissioner’s recommendation where the employer is named as CGB.ie Ltd t/a Car Buyers Guide. The Tribunal was also informed that the employer had changed the company name to Beaulouis Limited by resolution dated 30 April 2013.
Determination
The Tribunal heard the parties present at the hearing of the appeal of the recommendation of the Rights Commissioner and make a determination to dismiss the appeal and uphold the Rights Commissioner recommendation awarding the respondent (the employee) the sum of €10,000.00 under the Unfair Dismissals Acts 1977 to 2007.
