The decision of the Tribunal was as follows:-
A minimum notice claim was brought in respect of a general operative whose employment with the respondent was alleged to have commenced on 21 March 2012 and ended without notice on 14 December 2012. His gross pay was alleged to have been €324.38 per week.
No evidence was offered by or on behalf of the respondent to dispute the claimant’s entitlement to a minimum notice payment.
Determination:
Given that there was no evidence against the claimant having an entitlement to a minimum notice payment, the Tribunal allows the claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, and awards the claimant the sum of €324.38 (this amount being equivalent to one week’s gross pay) under the said legislation.
