Summary of Case
The Tribunal heard evidence from a director of the respondent company that he met with all employees on 28 October 2011 and informed them that the business was due to close as and from 6 December 2011 with the result that all employees would be made redundant. All employees were notified in writing of this position.
The claimant’s representative submitted to the Tribunal that the aforementioned meeting of 28 October 2011 did not constitute notice of termination of employment.
Determination
The Tribunal after consideration of the oral and documentary evidence is satisfied that notice of termination of employment was given to the employees at the meeting convened on 28 October 2011. The Tribunal finds that the statutory obligations under the Minimum Notice and Terms of Employment Acts 1973 to 2005 were complied with and accordingly the claims in respect of all the claimants fail.
