The determination of the Tribunal was as follows:-
This case came to the Tribunal by way of an employee’s claims for implementation of Rights Commissioner’s recommendations.
Determination:
As the Rights Commissioner’s recommendations (reference r-132146-UD-13/JW has not been carried out by the employer, the time for bringing an appeal has expired and no appeal has been brought the Tribunal in applying section 8 (4) of the Unfair Dismissals Act as substituted by section 7 of the 1993 Act, makes a determination to the like effect as the Rights Commissioner Recommendation r-132146-UD-13/JW under the Unfair Dismissals Acts, 1977 to 2007, in which it was ordered that the employer pay the employee the sum of €4,000.00 (four thousand euro).
As the Rights Commissioner’s recommendation r-129902-te-13/JW has not been carried out by the employer, the time for bringing an appeal has expired and no appeal has been brought the Tribunal in applying section 8(6)(a) of the Terms of Employment (Information) Act, 1994 makes a determination to the like effect as Rights Commissioner Recommendation r-129902-te-13/JW under the Terms of Employment (Information) Acts, 1994 and 2001, (by which the employee in question was awarded the sum of €400.00).
