The determination of the Tribunal was as follows:
Determination:
Based on the uncontested evidence the Tribunal finds the claimant was unfairly dismissed. However, it became clear in the claimant’s sworn evidence that she had not fully mitigated her loss after her dismissal. Accordingly, the Tribunal awards the maximum award in these circumstances of €318.04, this being four weeks gross wages, under the Unfair Dismissals Acts, 1977 to 2007.
The claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 was dismissed.
