The decision of the Tribunal was as follows:
Having heard and considered brief evidence from the appellant and the respondent the Tribunal is satisfied that the appellant’s employment with the respondent terminated by way of redundancy. The appellant was placed on short time in 2011 and asked the respondent on many occasions to be reinstated back to his full time position. The respondent agreed that the appellant objected to being placed on short time and sought a return to his fulltime hours.
The appeal under the Redundancy Payments Acts, 1967 to 2007 is allowed and the appellant is awarded a statutory lump sum payment under those Acts, and based on the following:

Date of Termination: 6 April 2012
Gross Weekly Wage : €312.00 (amount based on appellant’s 2010 P60)
This award is made subject to the appellant being in insurable employment under the relevant Social Welfare legislation during the appropriate period.
