Claimant’s Case
The claimant gave evidence of the respondent organisation and his role in the business. The claimant outlined a situation where he was on sick leave for a period of time and on contacting the respondent he was asked for a fit to return to work certificate and told to take some extra time off to rest. The claimant made numerous requests for a return to work but the respondent refused to engage with him. The claimant gave evidence of his loss and his attempts to mitigate his loss.
Determination:
Based on the uncontested evidence the Tribunal finds the claimant was unfairly dismissed and awards the sum of € 20,800.00 under the Unfair Dismissals Acts, 1977 to 2007.
