This case came before the Tribunal by way of appeals against the recommendations of a Rights’ Commissioner references r-102466-ud-10/DI, r-120319-pw-10/DI, r-120320-te-10/DI
The determination of the Tribunal was as follows:
It emerged that the appellant received a statutory redundancy payment from the respondents. That being the case, his appeal under the Unfair Dismissals Acts, 1977 to 2007 must fall. The Tribunal therefore upholds and re-affirms the Rights’ Commissioner’s recommendation under those Acts.
It also became clear during this hearing that the appellant was seeking implementation of the Rights’ Commissioner’s recommendations under the Payment of Wages Acts, 1991, and the Terms of Employment (Information) Act, 1994 and 2001. Those appeals under the above Acts were withdrawn.
