The determination of the Tribunal was as follows:
Determination:
Being satisfied that the respondent was properly on notice of the hearing the Tribunal proceeded to hear the claim. In circumstances where the respondent was not in a position to give evidence the claim under theUnfair Dismissals Acts must succeed as the onus of proof rests on the respondent to satisfy the Tribunal that the dismissal was not unfair.
The uncontroverted evidence of the claimant was that he was dismissed in the course of a telephone conversation on 1 September 2012. Having heard evidence of loss and considering that the claimant obtained work at some €54 per week less than in this employment some nine days after his dismissal the Tribunal awards €6,000-00 under theUnfair Dismissals Acts, 1977 to 2007.
