Background:
The Tribunal extended the time limit for the claim from 52 weeks to 104 weeks as allowed for under the Acts.
It was conceded by the respondent that a redundancy situation existed in relation to the termination of the appellant’s employment as the business closed on 9th December 2011. The appellant was absent on sick leave from the 15th September 2010.
Determination
The Tribunal being satisfied that a genuine redundancy situation existed awards the appellant a lump sum payment under the Redundancy Payments Acts 1967 to 2007 based on the following criteria:
Date of Birth:
Date of Commencement: 27th December 2005
Period of sick leave in excess of 26 weeks: 17th March 2011 to 9th December 2011
Date of Termination: 9th December 2011
Gross Pay: €150
This award is made subject to the appellant having been in employment which is insurable for all purposes under the relevant Social Welfare Acts.
