Background:

The Tribunal extended the time limit for the claim from 52 weeks to 104 weeks as allowed for under the Acts.

It was conceded by the respondent that a redundancy situation existed in relation to the termination of the appellant’s employment as the business closed on 9^th December 2011. The appellant was absent on sick leave from the 15^th September 2010.

Determination

The Tribunal being satisfied that a genuine redundancy situation existed awards the appellant a lump sum payment under the Redundancy Payments Acts 1967 to 2007 based on the following criteria:

Period of sick leave in excess of 26 weeks:                17^th March 2011 to 9^th December 2011

Date of Termination:               9^th December 2011

Gross Pay:                               €150   

This award is made subject to the appellant having been in employment which is insurable for all purposes under the relevant Social Welfare Acts.
