The determination of the Tribunal was as follows:
At the outset the claim under the Redundancy Payments Acts, 1967 to 2007 was withdrawn.
Background:
The claimant gave uncontested evidence regarding his dismissal from the respondent’s employment as a radio station Manager. He stated that he had been dismissed for alleged misconduct. The incidents in question were not of his doing and no allegations were made against him.
Determination:
Based on the uncontested evidence of the claimant the Tribunal finds the claimant was unfairly dismissed. Accordingly, the Tribunal awards the sum of €39,750.00 under the Unfair Dismissals Acts, 1977 to 2007.
