The determination of the Tribunal was as follows:-
This case came before the Tribunal as an appeal by an employer, the appellant, of the Rights Commissioner recommendation under the Unfair Dismissals Acts, 1977 to 2007, reference number r-124351-ud-12/JW.
Determination
The Tribunal is satisfied that the appellant was properly on notice of the Hearing but neither the appellant nor a representative on their behalf attended the Hearing.
Accordingly the appeal under the Unfair Dismissals Acts, 1997 to 2007 fails for want of prosecution and the recommendation of the Rights Commissioner is upheld.
