The decision of the Tribunal was as follows:
Having heard brief evidence and submissions from the appellant’s side the Tribunal allows the appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005. Accordingly the appellant is awarded €400.00 as compensation under those Acts- that sum being the equivalent of two weeks’ gross wages.
Having reviewed the evidence and subsequent submission the Tribunal finds itself unable to accept jurisdiction to hear the appeal under the Redundancy Payments Acts, 1967 to 2007. The secretariat of the Tribunal recorded the receipt of the appellant’s application by way of a T1A form on 30 April 2013. The date of termination on that signed form was 31 August 2009. Even allowing for the notice period this application was outside the time allowed under that Act.
The appeal under the Organisation of Working Time Act 1997 falls for want of prosecution.
