This case came before the Tribunal as an appeal by an employer, the appellant, of the recommendation of the Rights Commissioner under the Terms of Employment (Information) Acts 1994 and 2001 (reference r-133653-te-13/RG).
Determination
The appellant’s representative told the Tribunal that he would not call evidence on the matter. He stated that his position is that the quantum of the Rights Commissioners Award was excessive.
The Tribunal finds that without evidence being adduced or formal submission being made it has no grounds for revisiting the recommendation of the Rights Commissioner accordingly the appeal is dismissed. The recommendation under the Terms of Employment (Information) Acts, 1994 and 2001 is upheld.
