Determination
The shop the claimant worked in ceased trading resulting in the termination of her employment as of 03 March 2012. The claimant received her Minimum Notice entitlement and her redundancy lump sum payment. The claim for unfair dismissal was lodged with the Tribunal on 27 March 2013. Even if exceptional circumstances existed to allow the Tribunal to extend the 6-month time limit for lodging a claim to 1 year, the claim was still lodged outside the maximum time of 1 year.
The Tribunal have no option but to decline jurisdiction to hear this case and the claim under the Unfair Dismissals Acts 1977 to 2007 necessarily fails.
