The determination of the Tribunal was as follows:-
GG (former interim treasurer of the respondent) did not dispute that there had been a voluntary strike-off of the respondent and that the claimant had had short-term contracts which excluded unfair dismissal legislation. The claimant’s representative stated to the Tribunal that the claimant had been “on the cusp of a contract of indefinite duration” and that it was open to the Tribunal to find that non-retention of the claimant had been a dismissal.
Determination:
Having considered the circumstances and the unfair dismissal exclusion of each short-term contract, the Tribunal finds that it does not have jurisdiction to hear the claim.
The claim under the Unfair Dismissals Acts, 1977 to 2007, fails.
